Powlin is a SaaS platform that monitors and analyzes the visibility of hotels in recommendations generated by artificial intelligence, such as ChatGPT. Powlin provides analytical data, strategic insights, and optimization recommendations based on that monitoring.

Powlin obtains data through APIs from third-party AI platforms. The accuracy, availability, and completeness of results depend on those external sources. Powlin is not responsible for changes, limitations, or interruptions caused by third-party platforms.

Powlin provides analytical information and recommendations only. It does not guarantee specific rankings, visibility results, bookings, revenue increases, or any other business outcome.

Powlin may offer a free audit under the name "I want to know if ChatGPT recommends my hotel". This free audit does not create any contractual obligation to purchase paid services and does not constitute a subscription.

Powlin offers paid monthly and annual subscription plans, priced per hotel.

Subscriptions begin on the payment date and renew automatically for the selected billing period unless canceled before the end of the current term.

Cancellation must be completed before the renewal date. After cancellation, the Customer will retain access to the service until the end of the billing period already paid for. After that period, access to the platform and all associated data may be suspended or permanently deleted.

Powlin reserves the right to change subscription prices at any time. Any price change will be communicated to the Customer by email at least 30 days before it takes effect.

The notice will expressly state the new price, the effective date, and the Customer's right to cancel the subscription before that date. If the Customer does not cancel before the effective date, continued use of the service from that date onward will constitute acceptance of the new price.

Price changes will not apply retroactively to any billing period that has already been paid.

Powlin may amend these Terms at any time. Material changes will be notified to the Customer by email at least 30 days in advance. The notice will describe the changes and the Customer's right to terminate the contract before the effective date of those changes. Continued use of the service from that date onward will constitute acceptance of the updated Terms.

Payments are processed through Stripe. All fees are due in advance for the selected billing period. The Customer is responsible for providing accurate and up-to-date billing information.

In the event of non-payment, Powlin reserves the right to suspend access to the service until payment has been successfully processed.

All payments are non-refundable, since Powlin provides digital analytical services with immediate access to the platform from the moment payment is made.

This policy does not apply in cases of material breach of contract by Powlin, or where applicable mandatory law requires otherwise.

Powlin makes reasonable efforts to ensure continuous access to the platform. Scheduled maintenance will be announced with reasonable prior notice where possible. Powlin does not guarantee uninterrupted availability.

If the service is unavailable for more than 72 consecutive hours for reasons attributable to Powlin, the Customer may request a proportional service credit for the affected period. This credit is the Customer's sole remedy for service interruptions and does not entitle the Customer to terminate the contract unless the unavailability is persistent and materially affects the contractual purpose.

The Customer undertakes to provide truthful information during registration and throughout the subscription; use the platform exclusively for its own internal business purposes; not attempt to reverse engineer, copy, modify, or replicate the service or its underlying technology; not use the service in breach of applicable law; and keep its access credentials confidential.

The access account is personal and non-transferable. Each hotel requires its own active subscription. The Customer may not share, assign, or allow the use of the same account for more than one property without the corresponding hotel subscription.

All content, software, branding, algorithms, and materials related to Powlin are and remain the intellectual property of go visible online GmbH.

The Customer may use reports and recommendations internally for its own business purposes. Any resale, redistribution, reproduction, or commercialization of any Powlin output is prohibited without prior written authorization.

The processing of personal data in connection with the use of Powlin is governed by our Privacy Policy, available at powlin.com/politica-de-privacidad. By entering into this agreement, the Customer declares that it has read and understood that Policy.

Customer data stored on the platform will be retained during the active subscription period and for up to 30 days after cancellation or termination of the contract, during which time the Customer may request export of its data. After that period, the data will be permanently deleted.

Where the Customer provides personal data of third parties in connection with the service, such as hotel staff data, the Customer warrants that it has the necessary legal basis to do so under the applicable data protection laws.

The Customer may not set off its own claims against payment obligations owed to Powlin, nor exercise rights of retention in respect of such payments, unless those claims have been finally recognized by a court judgment, are undisputed, or arise from the same contractual relationship.

go visible online GmbH is liable without limitation for intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), and damages resulting from injury to life, body, or health.

In cases of slight negligence (einfache Fahrlässigkeit), liability is limited to breaches of essential contractual obligations (Kardinalpflichten) and to the amount of foreseeable damage typical for the contract.

Powlin is not liable for business decisions made by the Customer based on Powlin's recommendations; for loss of revenue or bookings; for changes in the behavior of AI platforms or the availability of third-party APIs; or for indirect or consequential damages, to the extent permitted by applicable law.

These Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For Customers who are merchants (Kaufleute), legal entities under public law, or special funds under public law, the exclusive place of jurisdiction shall be Mönchengladbach, Germany.

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic intent of the original provision.
